7:15 Attorney Jim Stinson, Davidson/McKevitt – Shorefront Protection
Mr. Stinson advised that project was approved in 1998, amended in 1999 and Arlene Wilson Associates filed paper work last year in order for his client to receive a certificate of compliance. Title problem as this project was to encompass two properties with two owners. File lost at Registry of Deeds but photocopies were obtained from conservation office. Bank was source for shellfish and requires ongoing re-nourishment. Mr. Stinson was advised that Mr. Davidson should have come back to the Commission when work was completed and the order of conditions has expired and cannot legally be amended. Beach nourishment is continued in perpetuity. Mr. Zoino suggested that the owner seek a hydro engineer to study elevations and give recommendations and then come back before the Commission.

7:30 Chris Our, 56 Obed Brooks Road, Map 64, Parcel M4-1 – construction of single family dwelling w/appurtenances
Lynn Hamlyn represented Mr. Our. A revised plan and landscaping plan were presented. Septic system is now 100' from neighbor's well. Mr. Strode indicated that there was too much lawn and suggested native species and ground cover on back side of property. Mr. Palmer moved to approve the project and close the portion of the hearing for public input, Order of Conditions to be drafted at a later time; Mr. Zoino seconding; motion carries; Mr. Strode in opposition.

7:45 George & Linda Shaw, 10 Brian Way, Map 104, Parcel E1 – construct 2 additions onto existing dwelling
Owners have requested continuance. Mr. Zoino moved to continue hearing to July 7, 2004 at 8PM; Mr. Bourgoin seconding ;motion carries.

8:00 Faith & John Preston Jr., 719 Queen Anne Road, Map 72, Parcel H301 – demolish existing dwelling; construct new dwelling including a patio and retaining wall; re-configure a portion of the driveway
Terry Ryder represented the applicants. Members raised questions concerning landscaping, patio and foundation placement. Mr. Zoino moved to continue to July 20 at 7:30 PM; Mr. Bourgoin seconding; motion carries.

8:15 Dublin Construction, 22 Chickadee Lane, Map 75, Parcel W3-6 – construct single family dwelling with attached garage, deck, a driveway, utilities, septic, grading, and appurtenances.
Robin Wilcox represented the applicant. Cease and desist was ordered from Commission while Administrator was on medical leave. The foundation is already in the ground and builder has received a building permit for it. Most of the construction lies within the 50 and 100 foot buffer zone and plan was not properly delineated. Lot lies adjacent to Muddy Creek and is in a water protection zone. No Notice of Intent was filed. Stabilization of lot needs to be done. Commission members noted displeasure with lack of filings and commented on history of Dublin Construction not adhering to regulations on many occasions. No landscaping plan has been presented. Lot may also lie within jurisdiction of Chatham due to Rivers Act. Werner Graptner and Roland Graptner,
neighbors, cited their concern over the clear-cutting of the lot and cited environmental concerns. Mr. Zoino moved for a continuance to July 7, 2004 at 8:15 in order to provide for a significant landscaping and site plan review ; Mr. Palmer seconding; motion carries.

Harry Segerstedt, Trustee, 11 Seymour Road, SE 32-1718 - septic system repair - Mr. Zoino moved to close the hearing and approve; Mr. Bourgoin seconding; motion carries.
Frank & Donna Doyle, 14 Riverbend, SE 32-1713 - beach grass to be planted on dune area, shed cannot be used as habitable space, small patio on SW side of house to be removed, revegetation - Mr. Palmer moved to close the hearing and approve, Mrs. Ford seconding, motion carries.
James Spalt, 80 Hoyt Road, SE 32-1714 - new house - Mrs. Ford moved to close the hearing and approve, Mr. Strode seconding; motion carries.
APPROVAL OF MINUTES
May 12, 2004 and June 1, 2004 - Mr. Bourgoin moved to approve both sets of minutes; Mr. Zoino seconding; motion carries.
ANY OTHER BUSINESS WHICH MAY COME BEFORE THE COMMISSION
Bid opening for RFP for "Great Swamp Bog" - one applicant - needs to be reviewed by Commission and Open Space Committee before recommendations. Commission members are to review application and make recommendation to Administrator. Commission will meet on June 29, 2004 at 6:30 PM with Open Space Committee to review and make recommendations.
