Notice of Intent – Continuance…
timeMinute35Hour186:35    Ann & Leo Higdon, Streetaddress8 Ayer Lane, Map 7, Parcel A16 – Permit to reconstruct an existing patio (after-the-fact); Replanting of disturbed area between patio and coastal bank.

Attorney William Crowell represented the Higdons.  After conferring with the Higdons, Mr. Crowell offered the following:  1.  There is to be no grass mitigation.   2.  Wall to be capped and patio and wall will be left as they presently exist. 3.  Re-plant coastal bank per J.M. O'Reilly plan of dateYear2008Day5Month3March 5, 2008. 4.  Install new Title 5 system within three years.  5.  Cap irrigation system between wall and front of property.   Mike Takach the landscaper who built the wall requested permission to finish capping wall and was advised that he proceeds at his own risk and there is a ten day appeal period following this hearing.  Mr. Bourgoin moved to approve the project, Order of Conditions to be drafted at a later time, Mr. Schreibman seconding, motion carries.

Remove existing dock/pier (78 sf +/-) and re-construct with aluminum frame 24’ x 4’ dock/pier to access Aunt Edie’s Pond.

Matt Farrell represented the applicants.  Applicants are proposing removing permanent dock and float and replace with seasonal dock and float.  Previous owner had never recorded the Order of Conditions for the old dock.  Mr. Farrell requested that the vegetation which was previously there be allowed to grow back naturally.  Some mitigation was proposed with two planting areas of blueberries and sweet pepper bush.  Mr. Schreibman noted the piles of brush and grass clippings and their effect on pond.  The chairman suggested a zig zag path to pond in order to help address runoff.  Mr. Ballantine moved to approve dock with the provision that at the 100' buffer line a row of sweet pepper and high bush blueberry be planted on the way across and leave rest to re-vegetate and revisit in one year from this date, (be included in the Order of Conditions, which is to be drafted at a later time) and path to meander, Mr. Bourgoin seconding, motion carries.

7:00      John Goodrich, 271 Bells Neck Road, Map 37, Parcel N6 – Construct in-ground pool, deck, pool house, equipment slab, bluestone patio, retaining walls, and lawn area.

Martin Moran represented the applicant.  Commission had previously raised concerns regarding wall in buffer zone and that will now be eliminated.  Pool house will be moved closer to 100' buffer line.  Deck around the pool will be shortened up.  Mr. Schreibman moved to approve the revised plan, Order of Conditions to be drafted at a later time; Mr. Ballantine seconding, motion carries.

Martin Moran represented the applicant.  Bulkhead is eroding and is proposing to dig by hand and no re-set of rocks.  Mr. Chatham noted that during a meeting with him and engineer he noted that work that is proposed needs to be located and saw random stones on beach which serve no purpose.  He suggested that toe stones should be dug in and make a revetment type of wall and should beach level drop, either remove stones or come up with an engineering plan for revetment which will afford double protection from sea.  Mr. Moran will confer with client over suggestions.  Mr. Bourgoin moved for continuance to dateYear2008Day21Month5May 21, 2008 meeting, Ms. Slifka seconding, motion carries, Mr. Schreibman opposed.

7:25      John McGrann, 356 Lower County Road, Map 13, Parcels V14 & V15 – Construct room addition with attached 25.6” x 26’ garage.

Mr. Bourgoin moved to approve requested continuance from R. J. O’Hearn to dateYear2008Day21Month5May 21,   2008, Ms. Slifka seconding, motion carries.

Notice of Intent
7:35      Peter Campbell for Thomas & Laura Hanley – 43 Saquatucket Bluffs Road, Map 9, Parcels A1-1; A1-4; A2-1 – Construction of pool and apron, vista pruning, and planting of privacy vegetation.

Thad Eldredge represented the applicants. Applicant proposing to re-locate a minimum of 23 trees on property with vista pruning.  Some work will be done by hand but larger trees will be dug by machine.  Trees will be replanted to ensure stability of coastal bank.  Asked for permission to remove two dead trees and one injured tree.  Would like to replace trees or fence for privacy plantings.  Mr. Chatham advised that most of proposed is within the no disturb zone but leave coastal bank alone but suggested vista pruning for view.  Mr. Bourgoin suggested removal of broken and dead trees but leave stump of broken tree.  Mr. Schreibman moved to approve with the condition that there be no work within buffer except vista pruning and removal of two trees and one broken tree (to be included into the Order of Conditions which will be drafted at a later time), Mr. Bourgoin seconding, motion carries.
