Notice of Intent – Continuance…
6:35  Lawrence McKevitt & Mary Ann Davidson 37 & 41 Nons Road, Map 5, Parcels W1-18 & W1-19 – Construction of a wooden/vinyl bulkhead to stabilize coastal bank and reduce siltation to and loss of shellfish habitat and still allow sediment to down-drift coastal beaches.

Norman Hayes represented the applicants.  No additional comments from DEP have been received concerning this project.  Spartina Alterniflora (beach grass) will be planted along landscape enhancement bulkhead to help hold up collapsing coastal bank along with natural indigenous material.  This will run 381' in length and placed above the mean high water line.  Need to allow for 100 year storm event under the sea wall to provide sediment for coastal bank. McKevitt's shed will be moved to driveway area and will build a small ramp to beach.  Interlocking rubber mats will be utilized in project.  CityplaceSandy beach devoid of vegetation will be staging area.  At eastern end of project it is assumed salt marsh is due to spartina growth, which slows water and allows for small crustaceans.  Proposed project will be done by year's end.  Mr. Ballantine moved to approve the project and to include conditions that it not be done concurrently with Oyster Creek dredging, to include shellfish monitoring, and in the event spartina fails that the project come back before Commission for review over a three-year period, final conditions will be drafted at a later time;  Mr. Bourgoin seconding, motion carries. The Chairman thanked the owners for their patience and willingness to work on this project.

Martin Moran represented the applicant.  Owner is happy to comply with Commission requests.  Commission noted items that need to be shown on plan - no elevation shown and width of stones which could be determined by contractor.  Mr. Bourgoin moved to approve the project with change on plan, Order of Conditions to be drafted at a later time; Mr. Ballantine seconding, motion carries.

7:10      John McGrann, 356 Lower County Road, Map 13, Parcels V14 & V15 – Construct room addition with attached 25.6” x 26’ garage.

Dick O’Hearn represented the applicant.  Proposed is now out of 50’ buffer.  Mr. Bourgoin moved to approve the project with the provision that a construction protocol and vegetation plan be provided, Order of Conditions to be drafted at a later time; Mr. Schreibman seconding, motion carries.

Request to Amend Order of Conditions
7:25      Conway Realty Trust, 264 Long Pond Drive, Map 103, Parcel A1 – Amend existing Order of Conditions to include the construction of two additional decks on existing cottage.  Previously permitted under DEP File #SE 32-1817.

Caitlin Merrill from East Cape Engineering represented the applicant.  Dwelling is a re-located cottage within 50’ of Long Pond and bordering vegetated wetland.  Would like to add decking to east side and provide two egresses for foot traffic.  Mr. Bourgoin added that the Commission has not allowed variance in 1 1/2 years since regulation inception. It was noted by Commission that silt fence and hay bales were destroyed on property. Run-off, landscaping and vegetation plans were not presented.  Mr. Bourgoin moved to continue to dateYear2008Day1Month7July 1, 2008, Mr. Schreibman seconding, motion carries.

Red River Beach – Complaint filed by Dean Knight to DEP, Selectmen, Town Administrator and Commission regarding seaweed at Red River Beach; 2002 dilemma over codium at beach and Town came up with dune restoration plan using said material.  Notice of Intent was filed and expires in 2010 but Town is running out of space to utilize codium.  Placed material on seaweed side of dune and thus violated Order of Conditions.  Mr. Ballantine moved to require administrator to prepare amendment to Order of Conditions for consideration at the meeting to be held  timeMinute55Hour20June 17, 2008, Ms. Slifka seconding, motion carries.

Mike Lach reported that sign permits have been approved by Building Department but requires Commission approval to be placed on Town lands under Commission jurisdiction.  Mr. Schreibman moved to approve signs on lands under Town jurisdiction held by Conservation Trust, Mr. Ballantine seconding, motion carries.
