Request to Amend Order of Conditions

Town is requesting an amendment to the dune enhancement Order of Conditions. Requesting a change in location of seaweed deposition associated with the “Dune Enhancement Program”.
In 2002 Commission approved Order of Conditions to address codium problem at beach and said Orders outlined three areas to be utilized in order to do dune restoration using the codium. Codium is heavy and significant in numbers and must be removed with front end loader. Seaweed cannot be burned at landfill due to DEP regulations nor can it be composted due to beach sand. Keeping beaches clean is a prime concern of town government and citizenry. Codium was placed in front of dunes and covered with sand for dune nourishment. 2007 dredging in Allen’s Harbor produced sand which was stockpiled at Earle Road beach and then taken to Red River Beach at west and east end sites. This spring the Highway Department contacted Administrator to inform him of large amounts of codium that had washed
ashore and Mr. Chatham made decision to use in dune on east end. If stockpiled, beach would run out of dune space. Commission, Board of Selectmen and DEP received complaint from Dean Knight. Commission had no quorum for dateYear2008Day21Month5May 21, 2008 meeting and Mr. Chatham attended Board of Selectmen meeting to inform that Board of what was taking place at PlaceNameplaceRed River PlaceTypeBeach. Amendment would allow Town to stockpile codium at a height of four to five feet and continuing until end of summer and come back in fall of this year or spring of next year to begin planting beach grass. Barber sand rake will be used to groom beach. Seaweed is relentless and if operation is suspended, could have negative environmental and economic impact. Dean Knight, complainant, presented list of demands to the Commission, a copy of which is incorporated with these minutes and made a part thereof. A petition was presented signed by over 50 people
supporting Mr. Knight's concerns. Jane Chase, StreetaddressHersey Road resident, felt Board of Selectmen answers to query were "inadequate". Walter Stratton from Highway Department informed that dune has been cut into and found seaweed is breaking down more quickly than first believed. Ms. Slifka suggested the creation of a Red River Beach Committee to formulate long term plan for beach. Mr. Ballantine moved to accept Town proposal to amend Orders of Condition and to form a committee to look at long term solutions this fall (2008), Mr. Schreibman seconding, motion carries. Mr. Ballantine moved to close hearing in order to sign Orders of Condition, Mr. Bourgoin seconding, unanimous vote motion carries.

Mr. Chatham suggested taking the above three parcels in one hearing due to common ownership and all lie in one subdivision. Robert Fitzgerald represented the applicant. Lot 1 has a portion within 100' buffer zone, Lot 2 has a portion of proposed house within 100' buffer and Lot 3 has a large encroachment into 100' buffer but is proposing to not cut trees and planting native grasses in back yards of properties. Mr. Ballantine suggested placing split rail fence on properties to delineate properties from wetlands. Ms. Slifka suggested construction protocol to afford protection where outwash lay. Mr. Bourgoin moved to approve placeLot 1 with Order of Conditions to be drafted at a later time, Mr. Ballantine seconding, motion carries. Mr. Ballantine moved to approve placeLot 2 with Order

7:45 James D. Power III, 21 Skinequit Road, Map 25, Parcel C3-11 – Construct walkway to, and dock on Skinequit Pond.
Bob Perry represented the applicant. Owner is proposing seasonal ramp, dock and floats. Hopes to create a more diversified evergreen community by planting 24 to 36 shrubs. Chairman informed that vista deck is a concern as regulations only allow for a 3' walkway. 100 square foot seating platform was deemed too large.
